Washington, D.C. – Today, U.S. Rep. Terri Sewell (AL-07) joined 222 of her colleagues in voting for H.Res. 21, a resolution that calls upon Vice President Pence to convene and mobilize the Cabinet to activate the 25th Amendment to declare the President incapable of executing the duties of his office, after which the Vice President would immediately exercise powers as acting President.

“What we saw at the U.S. Capitol last week was an insurrection against the U.S. government, encouraged by none other than the President of the United States,” Sewell said. “The President has shown himself to be incapable of carrying out the most basic of his duties and every minute that he remains in office is a threat to our democracy. If Vice President Pence and the cabinet fail to uphold their constitutional duty to protect this nation, Congress will be forced to carry out our solemn duty and impeach President Trump for incitement of insurrection.”

Specifically, H.Res. 21 resolves that the House of Representatives calls upon Vice President Michael R. Pence:

  • To immediately use his powers under Section 4 of the 25th Amendment to convene and mobilize the principal officers of the executive departments in the Cabinet to declare what is obvious to a horrified Nation: That the President is unable to successfully discharge the duties and powers of his office; and
  • To transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives notice that he will be immediately assuming the powers and duties of the office as Acting President.
